These Terms of Service ("Terms") govern all bookings and live music performance services provided by Mason Douglas ("Performer," "I," "me"). By submitting a booking request or confirming an engagement you ("Client," "you") agree to these Terms in full.
A booking request submitted through this website is non-binding and does not guarantee availability. A booking is only confirmed once both parties have agreed in writing (email or signed contract) to the date, time, location, performance scope, and fee. Until written confirmation is provided, the requested date remains open and may be offered to other clients.
A non-refundable deposit may be required to secure the booking date. The deposit amount and payment schedule will be outlined in the booking confirmation or contract. The remaining balance is due on or before the date of the event unless otherwise agreed in writing. Accepted payment methods will be communicated at the time of booking.
Client cancellation: If you cancel a confirmed booking, the deposit is non-refundable. Cancellations made less than 30 days before the event may be subject to the full performance fee.
Performer cancellation: In the unlikely event that I must cancel due to illness, emergency, or circumstances beyond my control, I will provide as much notice as possible, refund any deposit or payments received, and make reasonable efforts to help you find a replacement performer.
Rescheduling: Requests to reschedule will be accommodated where possible based on availability. Rescheduling is not guaranteed and is subject to mutual agreement.
The performance will consist of live music as agreed upon in the booking confirmation, including set length, number of sets, and general style or song preferences. While I make every effort to honour song requests, specific songs cannot be guaranteed unless they appear on the published song list or have been confirmed in advance as learnable. Sound equipment, setup requirements, and any technical needs will be discussed prior to the event.
The Client agrees to provide:
— A suitable performance area that is safe, dry, sheltered from weather (for outdoor events), and accessible for equipment load-in.
— Adequate electrical power within reasonable proximity of the performance area.
— Accurate event details including venue address, event timeline, and a point-of-contact available on the day of the event.
Any additional costs incurred due to unforeseen requirements at the venue (such as extended travel, parking fees, or additional equipment) may be billed separately.
I may take or share photos and short video clips from events for promotional purposes on social media, this website, or marketing materials. No full audio or video recordings of private events will be shared publicly. If you prefer that no media be captured or shared from your event, please let me know in writing before the event date and I will respect that request.
I carry and maintain my own equipment with care. However, I am not liable for any injury, damage, or loss incurred at the event venue, nor for any disruptions caused by factors outside my control (including but not limited to power outages, extreme weather, venue issues, or acts of God). My total liability in connection with any booking shall not exceed the total fee paid for that performance.
Neither party shall be held liable for failure to perform obligations under these Terms if such failure results from circumstances beyond reasonable control, including but not limited to natural disasters, pandemics, government restrictions, severe weather, or other unforeseeable events.
All original musical arrangements, setlists, and promotional materials remain the intellectual property of Mason Douglas. Songs performed are covered under applicable licensing. Clients may not record, distribute, or commercially use audio or video of performances without prior written consent.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada. Any disputes arising from these Terms shall be resolved through good-faith negotiation before pursuing any formal legal action.
I reserve the right to update these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of this website or booking of services after changes have been posted constitutes acceptance of the revised Terms.
